OVERVIEW

This website is operated by Duksi hereinafter referred to as "the Platform," "we," "us." Duksi provides an exclusive online e-learning platform for Islamic education. All functionalities, tools, and services (collectively, the "Service") are offered to you conditioned on your acceptance of all terms, conditions, policies, and notices stated here.

By registering on the Platform, creating an account, or using the Service in any way, you agree to these Terms and Conditions. These terms apply to all users of the Platform, including visitors, students, and teachers.

Please read these Terms and Conditions carefully before using our platform. If you do not agree to all provisions, you must not use the website or create an account.

We reserve the right to update these Terms and Conditions at any time. The current version is always available on this page. It is your responsibility to check for changes. Your continued use of the Platform following the posting of changes constitutes your acceptance of those changes.


ARTICLE 1 - ACCOUNTS AND REGISTRATION

1.1. Registration: To make full use of the Service, you must create an account. By doing so, you declare that you are 16 years of age or older, or that you have consent from a parent or guardian if you are under 16.

1.2. Account Types:

* Student Account: Provides access to courses, learning materials, and community functions.

* Teacher Account: Enables users to create, offer, and manage courses and interact with students.

1.3. Accuracy: You guarantee that all provided registration details are accurate, truthful, and complete. You are responsible for keeping this information up to date.

1.4. Confidentiality: You are responsible for maintaining the confidentiality of your password and for all activities under your account. Report any misuse or unauthorized use of your account immediately.

ARTICLE 2 - ACCEPTABLE USE, BEHAVIOR, AND CONTENT GUIDELINES

2.1. General: You may not use the Service for any illegal or prohibited purposes. In using the Service, you must not violate any laws in your jurisdiction.

2.2. Platform Purpose: This platform is exclusively intended for content that aligns with Islamic creed and law (Sharia). It is forbidden to post or distribute content that contradicts this.

2.3. Strictly Prohibited Content and Behavior: You agree to absolutely NOT upload, share, distribute, or engage in behavior that involves:
  1. a) Non-Islamic or Heretical Content: Content contrary to the fundamentals of Islam (Aqeedah) as established in the Quran and the authentic Sunnah. This includes, but is not limited to:
* Promoting non-Islamic religious practices or innovations (Bid'ah) that conflict with the consensus of Islamic scholars.

* Spreading sectarian ideologies or inciting division among Muslims.

* Casting doubt on fundamental Islamic principles in a way that leads to misguidance.
  1. b) Criminal Content: Content that incites or provides instructions for criminal activities.
  2. c) Inappropriate Behavior: It is strictly forbidden to:
* Express threats towards other users.

* Make sexual advances, use explicit language, or make inappropriate propositions.

* Make marriage proposals via the platform.

* Engage in any other inappropriate, intimidating, or disrespectful behavior.
  1. d) Other Prohibited Content: Content that is illegal, hateful, defamatory, libelous, or otherwise offensive, or that infringes on the intellectual property or privacy rights of third parties.


2.4. User-Generated Content: The Platform acts solely as a technical system. Teachers are solely and fully responsible for the content, quality, accuracy, and Islamic correctness of the courses and materials they offer ("Content"). We do not proactively monitor, endorse, or approve user Content but will actively enforce these Terms.




ARTICLE 3 - CONSEQUENCES OF VIOLATION

3.1. Immediate Sanctions: Any violation of the provisions in Article 2.3 will lead to the immediate and permanent termination of your account (permanent ban), without prior warning.

3.2. Financial Consequences: In the event of such a violation:

* For Students: Any right to a refund of already paid course fees is forfeited. No restitution will be granted.

* For Teachers: Any right to payout of currently unpaid earnings (revenue) is forfeited. Already generated revenue will not be paid out.

3.3. Right to Claim Damages: We reserve the right to claim further damages resulting from your violation.




ARTICLE 4 - INTELLECTUAL PROPERTY

4.1. Platform Technology: All intellectual property rights to the underlying software, technology, design, logos, and trademarks of the Platform are and remain our property or that of our licensors.

4.2. Teacher Content: The teacher retains all intellectual property rights to the content they create and upload. By posting Content on the Platform, the teacher grants the Platform a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, and publicly display this Content, solely for the purpose of providing the Service.




ARTICLE 5 - SALES TERMS, PAYMENTS, AND RIGHT OF WITHDRAWAL

5.1. Mandatory Information (According to Online Sales Checklist): Before a consumer purchases a course or creates an account, we will clearly provide the following information:

* The main characteristics of the course (content, level, duration).

* The full price, including all taxes.

* Information on the processing of personal data (see Privacy Policy).

* The payment methods we accept.

* A link to this withdrawal form.

* Important: We point out that digital content found to contain non-Islamic or prohibited elements is a violation of our terms and is not part of the agreement. Consumers retain their statutory rights against the teacher as the provider of the content.

5.2. Right of Withdrawal for Digital Content: You have the right to withdraw from a purchase agreement for a course (digital content) within 14 days without giving any reason, unless you have expressly consented to the start of the performance during the withdrawal period and acknowledged that you will lose your right of withdrawal. Once the service performance (e.g., access to the course) has begun, the right of withdrawal can no longer be exercised.

5.3. Order Process: The order process is clear and step-by-step. The "Order and Pay" button indicates a payment obligation. After payment, you will receive immediate written (via email) confirmation of the agreement.

5.4. Commission and Payouts: The Platform deducts a commission for the use of the system. The remaining amount is paid out to the teacher according to the schedule stated on the Platform.

ARTICLE 6 - LIABILITY AND DISCLAIMER

6.1. Platform as a System: The Platform provides only the technical system. We are not a party to the agreement between student and teacher. We are not responsible for the quality, accuracy, legal compliance, or Islamic correctness of the courses offered by teachers.

6.2. No Warranty: The Service is provided 'as is' and 'as available'. We give no express or implied warranties regarding the Service.

6.3. Liability Limitation: Our liability is limited to the amount the user has paid to the Platform in the past 12 months. We are in no case liable for indirect damages.




ARTICLE 7 - PRIVACY

The processing of personal data is governed by our separately published Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).




ARTICLE 8 - APPLICABLE LAW AND DISPUTES

8.1. Applicable Law: These terms and conditions are governed by Dutch law.

8.2. Consumer Disputes: Consumers have the option to submit disputes to the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/. We are not obliged nor do we intend to use a dispute resolution body.
